LAGOON SOFTWARE / FULL GAME AHEAD
Version v2026.10b. Last updated: October 6, 2026.

IMPORTANT - READ CAREFULLY

Key facts

1. GENERAL TERMS OF USE

1.1 Your Agreement to These Terms of Service

These Terms of Service (“Terms”) govern your use of all videogames, websites, smart phone applications, services, forums and/or internal messaging systems (collectively, the "Services") created, licensed, promoted or offered by Full Game Ahead or Lagoon Software (collectively "FGA"). Your use of the Services constitutes your acceptance of these Terms. If you do not agree to the Terms, you may not use the Services. The terms "you," "your," and "yours" refer to you, the visitor to or user of the Services. The terms "we," "us," and "our" refer to FGA.

1.2. Updates to the Terms of Service.

We may update these Terms. Significant changes are published at least thirty (30) days before they take effect; other changes, such as corrections or changes required by law, apply as soon as they are published. Changes to the rates and reward prices of the Promotional Programs follow the notice procedure set out in Section 5.1. When we do, we will revise the "last updated" date at the top of these Terms. You should check these Terms frequently to see recent changes. You agree that your continued use of the Services after such changes have been published to the Services shall constitute your acceptance of such revised Terms. This version of these Terms shall supersede all earlier versions.

1.3. Your License to Use the Services.

Subject to these Terms, FGA grants you a non-exclusive, limited, revocable, non-transferable, license to use the Services, including the products, applications, content and material thereof, for your personal, non-commercial use. The Services and their content may not be reproduced, duplicated, copied, resold, sublicensed, or otherwise used in whole or in part by you for commercial purposes. You may not modify, translate, reverse-engineer, reverse-compile or decompile, disassemble or create derivative works from any of the Services or their content. We reserve the right to discontinue the Services or to change the content of the Services in any way and at any time, with or without notice to you, without liability, except that the Loyalty Program may only be ended with the notice provided in its rules and that Magic Points won in the Contests remain redeemable for one (1) year (Section 3.3).

1.4. Minimum Age.

You must be at least thirteen (13) years old, or the minimum age required in your country if higher, to use the Services. You must be at least eighteen (18) years old to use Piggy Prize and to register for any Promotional Program described in Section 5. Magic Points are credited only to players who have declared that they are eighteen (18) or older; no Magic Points are earned before this declaration. Younger players may see that the games offer rewards, but they cannot join the programs: registration for real-life prizes is refused to players under eighteen (18). By accessing the Services, you represent that you meet these age requirements.

1.5. Compliance with other Terms of Services.

If you access the Services through a third-party sign-in service (“SNS”), such as your Apple or Google account, you shall comply with the terms of service of the SNS as well as these Terms. Your violation of the terms of service of any applicable SNS shall constitute a violation of these Terms.

2. ACCESS TO THE SERVICES

2.1. Registering to Use the Services.

Before accessing or using the Services, you may be required to create an account with FGA ("Account") or have a valid SNS account through which you connect to the Services ("SNS Account"). You agree to provide true, accurate and complete information about yourself (“Account Information”) when creating the Account or, in the case of an SNS Account, you agree that the Account Information contained in your SNS Account is true, accurate and correct. You agree to update the Account Information contained in your Account and/or SNS Account so that it is true, accurate and complete whenever you are using the Services.

2.2. Multiple Accounts.

You may not have more than one Account or more than one SNS Account on any single SNS at any given time. You shall not create an Account or SNS Account using a false identity or information or on behalf of someone other than yourself. In the event of a dispute as to any Account or SNS Account, we will consider the Authorized Account Holder of the email address used to register to be the owner and responsible party for the Account or SNS Account. The “Authorized Account Holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address.

2.3. Termination of Your Access to the Services.

You are solely and entirely responsible for all activities that occur under your Account or SNS Account. We may terminate your access to the Services and/or your Account if you commit a material breach of these Terms, after notifying you. In case of fraud, cheating or a risk to other users, we may suspend your Account immediately.

You may delete your Account at any time from the app under Settings > Account > Destroy my account, or by sending a request to gdpr@full-game-ahead.com. The request can also be initiated online at https://rules.universal-game-connect.com/delete-account/. Deletion takes effect immediately and is final: your Account is deactivated at once and its data are permanently erased within fifteen (15) days, subject to legal retention obligations. Your account number is retained after deletion solely to inform you, if you sign in again, that your Account has been deleted.

2.4. Preservation of game data.

In accordance with our Privacy Policy and the General Data Protection Regulation: the main data of your player's account and your personal data are kept for as long as your Account exists, and then only for the periods required by law. Session and cache data are erased forty-five (45) days after your last played game. This forty-five (45) day rule never applies to purchased Virtual Items, Magic Points, Exchange Reference Units or reward progress, which are kept for as long as your Account exists.

3. IN-GAME VIRTUAL CURRENCY AND VIRTUAL ITEMS

3.1. Virtual Items.

The Services may include an opportunity for you to earn, buy or use in-game items such as “pearls,” “energy,” “sublives,” “gems,” or “points” (“Virtual Items”). In some circumstances, you may pay money to obtain Virtual Items. Virtual Items are not real money and do not have monetary value.

3.2. Restrictions on Virtual Items.

Virtual Items obtained via the Services are provided to you under a limited, personal, revocable, non-transferable, non-sublicenseable license to use within the Services. You have no property interest, right or title in or to any such Virtual Items. You shall not rent, lease, sell, trade, gift, bequeath or otherwise transfer your Account or SNS Account to anyone without FGA’s written permission. Virtual Items can never be transferred, sold or gifted to another player. Exchange Reference Units, such as Piggy Bank Dollars, and the Piggy Prize plaques that display them are not Virtual Items: they are governed by Section 5, which allows only the exchange of a plaque for another plaque of the same value in the same collection (Section 5.4.6.2). “Piggy Bank Dollars” constitute a virtual currency exclusively intended for use within the participating games. They have no intrinsic monetary value and cannot under any circumstances be exchanged or converted into real money, either directly or indirectly. Likewise, Piggy Bank Dollars cannot be used to obtain gifts, products, or services outside the terms strictly defined by these rules. The only way to obtain gifts within the participating games is to comply with the conditions and terms set forth in these rules, including the use of Magic Points and their conversion into Exchange Reference Units, in accordance with the applicable promotional programs. Any other attempt to exchange or use Piggy Bank Dollars outside the defined conditions is strictly prohibited and shall have no legal effect.

3.3. Forfeiture of Virtual Items.

Virtual Items purchased through the Apple® App Store or the Google Play® Store do not expire while your Account exists. Virtual Items, Magic Points and reward progress are lost only if you delete your Account, if your Account is terminated for a material breach of these Terms after notice, if they are forfeited for fraud or cheating (Section 4.9; Loyalty Program rules, section 5.2; Contest Rules, section 6), or if FGA discontinues the applicable Services; the Loyalty Program may only be ended with the notice provided in its rules, during which Magic Points can still be redeemed; if the Contests end, the Magic Points already won in them can still be redeemed for rewards for one (1) year after the end of the last Contest.

3.4. Purchasing Virtual Items.

Price and availability of Virtual Items are determined by FGA in its sole discretion and are subject to change without notice. We reserve the right, without prior notification, to limit the order quantity on any Virtual Items and/or to refuse to provide you with any Virtual Items. We generally deliver Virtual Items to your Account or SNS Account within ten (10) minutes after you purchase them. If Virtual Items have not been properly delivered to your Account or SNS Account, please contact our customer service department using the internal messaging system within any of our games for a full refund of any Virtual Items that were not delivered. There are no refunds after Virtual Items are delivered. You agree that all sales of Virtual Items are final. Some packs are presented as a chest or include a promotion; their content is displayed before purchase, and nothing is drawn after payment. The packs offered vary according to the player's previous purchases, and larger packs have a lower price per unit. A given pack costs the same for all players in the same country and store. In the Loyalty Program, Magic Points depend only on the price paid, never on the content of a pack, a chest or a promotion.

3.5 Eligibility for Multi-Game Bonuses

Multi-Game Bonuses allow players to earn Virtual Items, such as Gems and other in-game items, by completing specific objectives within our games. For new players of Prize Fiesta: players must play a minimum of forty (40) games on Prize Fiesta to qualify for Multi-Game Bonuses. For new players of Prize Blast: players must play and progress to Island 9 in the Prize Blast treasure hunt to qualify for Multi-Game Bonuses. For new players of Piggy Prize: players must register their account and play a minimum of three (3) hours of active gameplay on Piggy Prize to qualify for Multi-Game Bonuses. These eligibility criteria have been established to ensure that Multi-Game Bonuses are distributed fairly and consistently to all players. Players who do not meet the specified requirements will not qualify for Multi-Game Bonuses. Multi-Game Bonuses grant Virtual Items only; they never grant Magic Points.

4. ONLINE CONTENT AND CONDUCT

4.1. Communication Channels.

The Services may include opportunities to communicate on online forums, internal messaging and/or in-app forums (“Communication Channels”). To access one of our Communication Channels, you must register for an Account with FGA or access the Services via a SNS Account.

4.2. User Content.

Communication Channels may allow you to transmit writings, photos, graphics, comments, suggestions, files, links or other materials (collectively "User Content"). You shall not use any Communication Channels to transmit or publish any User Content that: (1) you do not have the right to use or which violates a third party's rights, including without limitation any privacy, publicity or intellectual property rights; (2) is unlawful, untrue, defamatory, abusive, tortious, threatening, harmful, obscene, indecent, advertising firearms or illegal drugs, homophobic, antisemitic, islamophobic or christianophobic, racist or pornographic; (3) would constitute or encourage a criminal offense; (4) contains any viruses, worms or similar software; (5) is harassing to other users or us; and/or (6) is otherwise objectionable to us in our sole discretion. You agree not to submit or distribute User Content that includes personal information about another person without that person's consent. You agree not to impersonate nor falsely state or represent your identity in any Communication Channel. To ensure a dynamic and fair gaming experience, players who remain inactive for a consecutive period of 30 days or more will have their level progression in the game Prize Fiesta reset to zero. Inactivity is defined as the absence of login and in-game activity during this period. This reset does not affect other elements of the account, such as accumulated gems, the balance of your piggy bank, and your gift progression.

4.3. Viewing or Receiving User Content.

You agree that by using the Communication Channels and/or Services you may be exposed to User Content that is indecent, explicit, and/or offensive. You bear all risks associated with use of the Communication Channels and Services. You agree that by using the Communication Channels and Services and/or applications that under no circumstances will we be liable in any way for any damage or loss of any kind incurred as a result of User Content.

4.4. Non-Commercial Use of the Communication Channels.

You may only use the Communication Channels in a noncommercial manner. You shall not distribute or otherwise publish on any Communication Channel any material containing any solicitation, promotion or advertising for goods or services.

4.5. Other Restrictions on Communication Channels.

You agree not to use any data mining tools or automation tools such as spiders, crawlers, scripts, bots, or any automated method of recording information in any Communication Channel. You agree not to engage in or facilitate the transmission of unsolicited mass mailing or "spamming" using any Communication Channel. You agree not to collect personal information about others using any Communication Channel.

4.6. Grant of License to FGA.

By transmitting User Content via any Communication Channel, you grant and/or warrant that all owners of any such User Content have expressly granted to FGA a fully paid, royalty-free, non-exclusive, irrevocable, worldwide, unconditional, perpetual, right and license to use, reproduce, modify, publish, and distribute all such User Content and/or to incorporate such materials in other works in any form, media, technology now known or later developed.

4.7. Monitoring Communication Channels.

We shall have the right, but not the responsibility, in our sole discretion, to monitor and/or remove any User Content transmitted by you via the Communication Channels that we believe to be harmful or offensive, or to otherwise violate these Terms or any other terms and conditions which we may institute from time to time.

Reporting and blocking. Each Communication Channel includes a “Report” function for any message or user and a “Block” function. Reports are reviewed within three (3) business days, Monday to Friday excluding public holidays; content that violates these Terms is removed and repeat offenders are suspended. Contact: customer-service@full-game-ahead.com.

4.8. We Do Not Endorse User Content.

Any opinions, advice, statements, services, offers or other information or content expressed or made available by third parties in the Communication Channels are those of the respective author(s) or distributor(s) and not of FGA.

4.9. Cheating.

Do not cheat when using any of the Services. Cheating is a violation of these Terms. If you use or attempt to use any cheat engine, software, device or process to tamper with or affect the operation of any of the Services or to gain an unfair advantage or by taking advantage of a breach over us or any other user of the Services, your Account may be suspended immediately and terminated as provided in Section 2.3. Any attempt to deliberately damage or undermine the legitimate operation of the Services is a violation of criminal and civil laws. Should such an attempt be made, we will seek damages or other remedies from any person engaging in such conduct.

5. FGA PROMOTIONAL REWARD PROGRAMS

PLEASE REVIEW THE FOLLOWING INFORMATION CAREFULLY TO FULLY UNDERSTAND HOW THE FGA PROMOTIONAL REWARD PROGRAMS OPERATE.

Questions and answers

Is the Game free? Yes. Downloading and playing the Participating Games is free. Purchases of Virtual Items are optional and are never needed to take part in a Promotional Program.

How does it work on Android and on platforms other than the Apple® App Store? Joining the Loyalty Program is free. Magic Points are earned by playing, even without any purchase, and can be redeemed for rewards. A player who never pays and plays about thirty (30) minutes a day can reach the least expensive reward of Prize Blast in about twenty-two (22) months, that of Prize Fiesta in about two years and that of Piggy Prize in about twenty-two (22) months with the three Golden Keys every new player receives. For comparison, in most mobile games the same playing time leaves nothing tangible at the end; here, it also leads to a real reward. Players who choose to buy Virtual Items receive them in full and, in addition, 5,650 Magic Points per 1.00 USD spent, under the conditions of Section 5.2.1. This applies to the Loyalty Program only.

How does it work on iPhone and iPad? In the Contests, participation is free: a player takes part by playing seven (7) minutes during the hour of a Contest, once per Contest. Winners are ranked by skill: first by the number of game levels completed during the hour with the moves given at the start of each level, without any item bought, and then by the fewest moves used. Purchases made on iPhone or iPad never grant participation, never grant Magic Points and never improve the ranking.

Does chance play a role? In the Loyalty Program, no: each reward has a total price in Magic Points, published in these Terms, and no game outcome changes it. Nor does it in the Contests: winners are designated by the ranking rules published in the Contest Rules, not by chance.

Is it a game of chance? A game of chance combines three elements: a stake paid by the player, an outcome decided by chance, and a prize. In the Loyalty Program, there is no stake, because joining is free and purchases pay for Virtual Items at their usual price, and there is no chance, because Magic Points and reward prices are fixed. In the Contests, there is neither stake nor chance: participation is free, and winners are designated by the ranking rules published in the Contest Rules.

On what legal basis? These three elements come from the law. In the United States, the Supreme Court held that a giveaway is not a lottery under federal law when participants give no money or other valuable consideration, and that having to listen to the broadcast is not such consideration (FCC v. American Broadcasting Co., 347 U.S. 284, 1954). In the United Kingdom, an arrangement is a lottery only if participants are required to pay to take part (Gambling Act 2005, section 14). In Germany, a game is gambling only if a payment is required for the chance of winning and chance decides the win entirely or mainly (Glücksspielstaatsvertrag 2021, section 3). In France, a game of chance requires the hope of a gain due, even partly, to chance, and a financial sacrifice from participants (Code de la sécurité intérieure, article L. 320-1, in force since January 1, 2020). The Loyalty Program is built on the conditions that Google Play sets for loyalty programs in games, in its Real-Money Gambling, Games, and Contests policy: rewards clearly supplementary and subordinate to genuine purchases, points awarded and redeemed on a fixed ratio published in the app and in these Terms, and never wagered, awarded or increased by game performance or chance. The fixed ratio applies in both directions: purchases earn 5,650 Magic Points per 1.00 USD, and each reward has a fixed price in Magic Points, both published in these Terms. Magic Points earned by playing are not linked to any purchase. The Contests are built on section 5.3 of Apple's App Store Review Guidelines, which covers sweepstakes and contests: they are sponsored by the developer, their official rules are presented in the app, and Apple is not a sponsor. The Loyalty Program is a loyalty scheme: Magic Points reward purchases and play at fixed, published rates. In the European Union, the Court of Justice has held that national rules may not prohibit in general the offer of a free gift or bonus linked to a purchase (VTB-VAB, joined cases C-261/07 and C-299/07, 2009; Mediaprint, C-540/08, 2010).

Where is it offered? Only in the countries listed in the rules of each Promotional Program. In other countries the corresponding features are disabled. Each list leaves out the jurisdictions where the program would require a registration, an authorization or another formality, or where it is prohibited. The lists differ because the two Promotional Programs are different: the Contests are prize promotions, which some jurisdictions regulate even when they are free and involve no chance; the Loyalty Program involves neither chance nor competition, since every player whose Magic Points cover the price of a reward receives it.

Is it worth playing? The Participating Games are free entertainment, and players are never required to pay. In addition to this entertainment, which most mobile games also offer, the Loyalty Program gives every player access to tangible rewards, which can be obtained by playing, even without any purchase; purchases make progress faster. On iPhone and iPad, players can take part in the Contests for free.

Is it profitable? The Programs are not a way to earn money: Magic Points and rewards cannot be exchanged for money. Compared with a game that offers entertainment only, a player of the Participating Games receives the same free entertainment and, in addition, tangible rewards. A player who would buy Virtual Items in any game receives, here, Magic Points on top of the Virtual Items bought. The market value of the rewards is lower than the amount of the purchases that earned the corresponding Magic Points: purchases pay for Virtual Items, and rewards come on top of them.

Can you really obtain rewards? Yes. Each reward has a price in Magic Points published in these Terms. When a player's Magic Points cover that price, the reward is delivered after the identity and address checks described in Section 5.5. As of September 25, 2026, FGA had awarded 6,611 rewards worldwide since 2010, with a total value of 1,790,700 US dollars. The list of reward recipients, with their first name, the initial of their last name, their country and their reward, and a photograph when they have sent one, is available in each Participating Game. Video testimonials of recipients are published on the YouTube channel "Full Game Ahead".

5.0 Nature of the Promotional Programs

  1. FGA offers two Promotional Programs: the Loyalty Program, available on the Google Play® Store and on all platforms other than the Apple® App Store, and the Contests, available on the Apple® App Store only. Each is governed by its own rules.
  2. Participation is free. No purchase is required to play the Participating Games or to take part in a Promotional Program. No part of any purchase is an entry fee or a wager.
  3. Virtual Items are sold at their usual price: the price and content of a pack never depend on whether the player takes part in the Loyalty Program. A purchase buys Virtual Items; Magic Points come in addition and are never what is bought. In the Loyalty Program, Magic Points are a supplementary benefit earned at rates set in advance: 5,650 Magic Points per 1.00 USD spent on Virtual Items, a daily amount for active play, which decreases after the first seven days, and 2,640 Magic Points for each day with at least thirty (30) minutes of play, as set out in Section 5.2.1.
  4. In the Loyalty Program, chance, skill and game performance have no effect on the number of Magic Points earned, on their exchange value, or on the rewards they give access to. Each reward has a total price in Magic Points, published in these Terms.
  5. All rates are fixed and published in these Terms and in the app under Menu > Rules > Magic Points. A rate may change for the future only, with thirty (30) days' notice published in these Terms. Magic Points already earned are never reduced, except in case of fraud or breach of the rules (Section 3.3).
  6. Magic Points have no cash value. They cannot be sold, transferred or exchanged for money, and they do not expire while your Account exists.
  7. Magic Points and Exchange Reference Units are never wagered and are never lost through play. In the Loyalty Program, no game result can increase or reduce them; in the Contests, Magic Points are awarded only as prizes of free contests, according to the ranking rules published in the Contest Rules. They can only be exchanged for the rewards of the Promotional Program in which they were earned, at the fixed prices published in these Terms.
  8. Rewards are funded by FGA as a loyalty benefit. Some rewards take the form of gift vouchers, which are a monetary equivalent of a tangible reward. Gift vouchers can only be used to buy goods or services from the retailer that issues them; they cannot be exchanged for cash, except where the law requires it.
  9. The Promotional Programs are open only to natural persons aged eighteen (18) or older, or the age of majority in their country if higher, residing in the countries listed in the rules of each Promotional Program. In all other countries the corresponding features are disabled.

5.1 General Information About the Promotional Programs

The FGA Promotional Reward Programs (the “Promotional Programs”) are the Loyalty Program and the Contests described in Section 5.2. Each Participating Game, including Prize Fiesta, Piggy Prize and Prize Blast (the “Participating Games”), operates its own Promotional Program. Through the Promotional Programs, players earn “Magic Points”. Magic Points are earned and redeemed at fixed ratios. The game displays them as in-game units called “Exchange Reference Units”, which are redeemed for tangible rewards at fixed prices. The redemption involves no chance, and its result depends only on the Magic Points (Section 5.1.1).

Definitions. “Loyalty Program” means the Promotional Program described in Section 5.2.1. “Contests” means the Promotional Program described in Section 5.2.2. “Pack” means an offer of Virtual Items sold for real money in the in-app store. “Sponsor” means Full Game Ahead Ltd, 9th Floor, Amtel Building, 148 Des Voeux Road Central, Hong Kong, holder of the developer account of the Participating Games on the Apple® App Store. On the Google Play® Store, the Participating Games are published by Lagoon Software Ltd (Section 13).

THE EXCHANGE RATIOS BETWEEN MAGIC POINTS, EXCHANGE REFERENCE UNITS AND EACH TANGIBLE REWARD ARE FIXED AND PUBLISHED IN THESE TERMS AND IN THE APP. FGA MAY CHANGE A RATIO OR A REWARD PRICE TO REFLECT CHANGES IN THE MARKET VALUE OF REWARDS, FOR THE FUTURE ONLY AND WITH THIRTY (30) DAYS' NOTICE PUBLISHED IN THESE TERMS. A CHANGE NEVER REDUCES MAGIC POINTS OR KEYS ALREADY EARNED AND NEVER APPLIES TO A REWARD WHOSE REDEMPTION HAS ALREADY STARTED.

5.1.1 Separation of game mechanics and Promotional Programs. Virtual Items obtained in the games have no money value and are never converted into Magic Points, rewards or money. The price of a reward in Magic Points is the same whatever the player's results in the games. In the Loyalty Program, no game feature determines the number of Magic Points earned; in both Promotional Programs, no game feature determines the Exchange Reference Units a player is entitled to or the tangible reward a player may redeem. The Exchange Reference Units credited to a player follow the fixed ratios applied to that player's Magic Points. A player whose Magic Points cover the price of a reward may obtain it directly from customer service or, if they prefer, unlock it in the game through the Exchange Reference Units displayed there (Section 5.4.3), with the same result. No game feature can reduce a player's entitlement.

5.1.2 Eligibility. The Promotional Programs are open only to natural persons aged eighteen (18) or older, or the age of majority in their country if higher, residing in the countries listed in the rules of each Promotional Program. The Promotional Programs are offered only in the countries listed in their rules; in all other countries the corresponding features are disabled. Age and country are declared at registration and verified against identity and address documents before any delivery. Magic Points are credited only to players who have declared that they are eighteen (18) or older; no Magic Points are earned before this declaration.

5.1.3 Access to the rules. These Terms and the rules of each Promotional Program are accessible at any time from the app under Menu > Rules and at https://rules.universal-game-connect.com/.

5.2 How to Earn Magic Points

For each Participating Game, you may participate in only one Promotional Program to earn Magic Points, determined by the platform from which you downloaded the app. Magic Points are kept separately for each platform. Magic Points earned in the Loyalty Program can be used only on platforms other than the Apple® App Store; on iPhone and iPad, only Magic Points won in the Contests can be used. The specific Promotional Programs applicable are outlined below:

5.2.1 Loyalty Program (Google Play® Store and all platforms other than the Apple® App Store)

The Loyalty Program is available only to players who download the Participating Games from the Google Play® Store or any platform other than the Apple® App Store. It is a supplementary benefit: participation is free, no portion of any purchase is a fee or a wager, and no purchase is required to play the Participating Games. Magic Points are earned in three ways only, at rates set in advance:

Joining the Loyalty Program is free. Magic Points are earned by playing, even without any purchase, and can be redeemed for rewards. A player who never pays and plays about thirty (30) minutes a day can reach the least expensive reward of Prize Blast in about twenty-two (22) months, that of Prize Fiesta in about two years and that of Piggy Prize in about twenty-two (22) months with the three Golden Keys every new player receives. For comparison, in most mobile games the same playing time leaves nothing tangible at the end; here, it also leads to a real reward.

The ratio and your current balance are displayed in the app under Menu > Rules > Magic Points. Magic Points are never granted, multiplied, reduced or lost on the basis of game performance, skill or any chance-based outcome. Magic Points do not expire. Multi-Game Bonuses, daily bonuses and all other free features grant Virtual Items only and never Magic Points; apart from purchases, only the active play described above grants Magic Points. The full rules of the Loyalty Program are available at https://rules.universal-game-connect.com/loyalty/.

5.2.2 Apple® App Store ONLY

On the Apple® App Store, the Participating Games offer free Contests instead of the Loyalty Program. iOS users who download our apps from the Apple® App Store may earn and accumulate Magic Points by participating in our FGA Contests, subject to eligibility requirements. Additional information on earning Magic Points through Contests can be found at: https://rules.universal-game-connect.com/v2/?lang=en.

APPLE® DISCLOSURE: The Contests offered by FGA are not sponsored, endorsed, administered by, or associated with Apple® in any manner. Apple® is not a sponsor of, or responsible for conducting, these Contests.

5.3 Bonus Magic Points for Legacy Program Participants

Players who participated in our previous reward programs prior to January 2025 have automatically converted their “Reward Points” into an equivalent number of “Magic Points” of the same value. At the time of the conversion, all rewards available in the previous reward program were made available in the new program at the same value. To reward their loyalty and prevent any loss due to decimal calculations during the conversion, a one percent (1%) bonus has been granted to them.

5.4 How to use my Magic Points to claim a Gift

5.4.1 Enrolling in the program

Completion of the (“Real-Life Prizes Registration Form”) within each Participating Game is mandatory to enable the exchange of Magic Points for tangible rewards.

By enrolling in this program: participants acknowledge that, before the delivery of a tangible reward, they sign the Affidavit of Eligibility/Compliance and the Liability Release described in Section 5.5. Participants who do not wish to sign these documents will remain eligible to earn Magic Points and participate in the program but will not be eligible to receive tangible rewards. To show that rewards are real, the list of reward recipients in each game shows the first name, the initial of the last name, the country and the reward of each recipient; a recipient may ask customer service at any time to be removed from it. Sending a photograph or a testimonial is never required: a recipient who sends neither still receives the reward.

By sending a photograph or a testimonial: reward recipients agree that FGA may use it, with their first name, in advertising and promotional materials for the Participating Games, including on the internet, without additional compensation except where prohibited by law, and for no unrelated purpose. They may withdraw this agreement at any time, for future materials, by contacting customer service.

5.4.2 Simple process to redeem your Magic Points for tangible rewards

The exchange of Magic Points for tangible rewards is presented in a game format. As you play, your Magic Points are converted into Exchange Reference Units, the in-game unit used by each Participating Game. Each tangible reward has a fixed price in Exchange Reference Units. In each Participating Game, all the Exchange Reference Units used for a reward, such as Bottles, Piggy Bank Dollars, Prize Points, Piggy's Money, Keys and badges, are taken from the same Magic Points: the total price of a reward in Magic Points, published in these Terms, includes all of them. The only exception is the Keys that Piggy Prize gives every player as a gift (Section 5.4.6). Each reward has its own price in Magic Points, set by FGA as in a catalogue. This price is published in these Terms and shown before the player chooses the reward; it does not change once the redemption has started. Each reward can be obtained only once per account.

The conversion involves no chance and no skill: the number of Exchange Reference Units a player receives is determined solely by the Magic Points in their account, at the fixed ratios published in these Terms, apart from the Keys given as a gift in Piggy Prize.

During play, the game displays the Exchange Reference Units corresponding to the player's Magic Points. Their number is set solely by the Magic Points, at the fixed ratios. A reward is delivered only once the player's Magic Points cover its total price, as shown in the app under Menu > Rules > Magic Points. In Piggy Prize, the Keys given as a gift can also count toward that price (Section 5.4.6).

In each Participating Game, progress toward a tangible reward may be cancelled free of charge once every thirty (30) days; all Exchange Reference Units applied to that reward are returned to the player.

5.4.3 Display of the conversion

Each game displays the conversion of Magic Points with at least two types of Exchange Reference Units:
step 1: the first type of exchange reference unit is used to unlock access to the rewards.
step 2: once this access has been unlocked, the second type of exchange reference unit allows players to claim tangible rewards.
A player whose Magic Points cover the price of a reward may obtain it directly from customer service, through the in-game messaging system, or, if they prefer, unlock it in the game through the Exchange Reference Units displayed there, with the same result. The Exchange Reference Units corresponding to that reward are then deducted from their account.

5.4.4 Display in the Prize Fiesta Game

In Prize Fiesta, the redemption of Magic Points is presented through interactions with the Dwarfs and a gift badges table. The exchange rates between Magic Points, Exchange Reference Units and gifts are fixed.

5.4.4.1 EXCHANGE REFERENCE UNITS FOR THE PRIZE FIESTA GAME:

Step 1:
Description: Accessing the Prize Cave.
Exchange Reference Units Name: Piggy Bank Dollars.
Fixed Rate: One hundred (100) Piggy Bank Dollars for every one hundred thirty-three thousand three hundred thirty-three (133,333) Magic Points earned.
Cost to Access the Prize Cave: One million (1,000,000) Magic Points, equivalent to seven hundred fifty (750) Piggy Bank Dollars.

Step 2:
Description: Claiming a tangible reward.
Exchange Reference Units Name: Prize Points.
Fixed Rate: Four hundred nine (409) Prize Points for every one thousand (1,000) Magic Points earned.
Cost for Tangible Rewards: Detailed accurately in Section 4 of the process outlined below.

5.4.4.2 STEP-BY-STEP TANGIBLE REWARD REDEMPTION PROCESS:

The process is outlined as follows.

1. Access the Prize Cave: To initiate the redemption process, players must open the Prize Cave. Access to the Prize Cave requires accumulating one million (1,000,000) Magic Points, which correspond to 750 Piggy Bank Dollars. In the game, players collect Piggy Bank dollars progressively, at the fixed rate of one hundred (100) Piggy Bank Dollars for every one hundred thirty-three thousand three hundred thirty-three (133,333) Magic Points earned. The player’s Piggy Bank dollars are utilized incrementally throughout their progression, with the total amount being fully applied upon final access to the Prize Cave.

2. Interact with the Dwarfs to Receive Prize Points: Within the Prize Cave, players can exchange their Magic Points for Prize Points by interacting with the Dwarfs. The Dwarfs display the conversion of Magic Points into Prize Points at the fixed ratio of 409 Prize Points per 1,000 Magic Points.

3. Choose and Unlock a Gift: Once inside the Prize Cave, select the gift you wish to unlock. Once your Magic Points cover the total price of a gift, your Piggy Bank always contains enough to unlock it, counting both the Prize Points already converted and the Magic Points still to be converted.

4. Earn Gift Badges and Complete the Gift Table to trigger the Gift delivery process: After selecting your desired gift, you will interact with an interface displaying a Gift Table. This Gift Table consists of rows of gift badges in various colors. To generate a gift badge, pay the corresponding cost in Prize Points for a badge in the first row. Each time you complete a row, the gift badges will merge to form a badge for the row above. The process continues until all rows are filled. Once the Gift Table is complete, the process to deliver your gift is triggered. ARV is the Average Retail Value of a tangible reward. Progress on a gift may be cancelled free of charge once every thirty (30) days, as provided in Section 5.4.2.

5.4.5 Display in the Prize Blast Game

In Prize Blast, the redemption of Magic Points is presented as a treasure hunt: players build a ship, sail to Treasure Island and merge gift badges. The exchange rates between Magic Points, Carton Gift Badges and rewards are fixed.

5.4.5.1 EXCHANGE REFERENCE UNITS FOR THE PRIZE BLAST GAME:

Step 1:
Description: Accessing the Prize Cave.
Exchange Reference Units Name: bottles.
Fixed Rate: Twenty-two thousand two hundred eighty-seven (22,287) bottles for every ten thousand (10,000) Magic Points.
Cost to Access the Prize Cave: One million (1,000,000) Magic Points.
Piggy Bank Dollars: one hundred (100) Piggy Bank Dollars for every one hundred thirty-three thousand three hundred thirty-three (133,333) Magic Points earned, used to unlock a gift in Step 4 below.

Step 2:
Description: Claiming a tangible reward.
Exchange Reference Units Name: Carton Gift Badge.
Fixed Rate: one (1) Carton Gift Badge for every twenty-seven thousand eight hundred forty-four (27,844) Magic Points gained for tangible rewards (or gifts) in category 1. For the fixed rates of gifts in other categories, please refer to paragraph 6 of section 5.4.5.2 below.
Cost for Tangible Rewards: Detailed accurately in Sub Section 6 of the process outlined below.

5.4.5.2 STEP-BY-STEP TANGIBLE REWARD REDEMPTION PROCESS:

The process is outlined as follows.

1. Build Your Ship: Begin your adventure by constructing your ship. As you accumulate Magic Points, the resources you receive are determined solely by your Magic Points, at the fixed ratios, to complete your vessel and set sail for Treasure Island. Along the way, Magic Points are gradually converted into Bottles, which serve as the intermediate currency needed to progress your journey.

2. Navigate to Treasure Island Once your ship is complete, navigate across the high seas to reach Treasure Island. Progress is determined by the Bottles derived from the player's Magic Points at the fixed ratios.

3. Enter the Prize Cave: Upon arriving at Treasure Island, you make your way through Pirate Island to reach the Prize Cave—a treasure trove where tangible rewards are unlocked. The Prize Cave opens once you have accumulated one million (1,000,000) Magic Points, which will have progressively been converted into the necessary Bottles. These Bottles are then used to unlock the Cavern. At each stage leading to the Cavern, a fraction of the required one million Magic Points is converted into Bottles, culminating in the total amount being applied upon final access to the Prize Cave.

4. Choose Your Gift: Select the gift category you wish to pursue. To unlock a gift, players use the Piggy Bank Dollars accumulated in their Piggy Bank. Your Piggy Bank always contains the Piggy Bank Dollars corresponding to the Magic Points you have earned, at the fixed ratio, so you can unlock any gift attainable with those Magic Points. Progress on a gift may be cancelled free of charge once every thirty (30) days; all Bottles and Piggy Bank amounts applied to that gift are returned to the player.

5. Craft and Merge Gift Badges: Players begin by crafting and merging objects to create Carton Gift Badges. Once a Carton Gift Badge is obtained, players can continue merging these badges to progress toward higher-tier rewards. Badge outcomes are strictly derived from the player's Magic Points balance at the fixed ratios set out in this Section. The merging hierarchy is as follows:
two Carton Gift Badges are merged to form one Bronze Badge;
two Bronze Badges merge into one Silver Badge;
two Silver Badges merge into one Gold Badge;
two Gold Badges merge into one Ruby Badge;
two Ruby Badges merge into one Multicolored Badge.
The merging hierarchy is fixed.

6. Complete the Badge Requirements to Trigger Delivery: Once the required number of Multicolored gift Badges has been obtained, the gift delivery process is triggered. Refer to the gift table, which outlines the number of Multicolored Badges required for each gift and the corresponding category of each reward. In the Prize Blast game, the number of Magic Points required to obtain a Carton Gift Badge varies depending on the tangible gift category.

5.4.6 DISPLAY IN THE PIGGY PRIZE GAME

In Piggy Prize, the redemption of Magic Points is presented through the collection of Piggy's Money, the forging of Keys and a journey to the Prize Cave. The exchange rates between Magic Points, Piggy's Money and Keys are fixed. The plaques, Keys and Piggy's Money a player receives are derived from their Magic Points at the fixed ratios set out below, apart from the Keys given as a gift; grid configurations and plaque materials change the presentation only, never the rate. The Piggy's Money credited to a player corresponds to the Magic Points earned.

Keys given as a gift. Every new player receives three (3) Golden Keys as a gift at the start of the game, without any purchase. Those that have never been used to unlock an offer count toward rewards in the Prize Cave like the Keys obtained from Magic Points. No other Key is given as a gift.

5.4.6.1 EXCHANGE REFERENCE UNITS FOR THE PIGGY PRIZE GAME:

Step 1: Unlocking Game Tracks
Description: This step entails unlocking nine (9) in-game tracks.
Exchange Reference Unit: Virtual Piggy Bank Units (hereinafter referred to as “Piggy’s Money”).
Fixed Exchange Rate: Ten thousand (10,000) Magic Points = thirty-two (32) Piggy’s Money units.
Accumulation Requirement: To unlock all nine (9) tracks, the user must accumulate five hundred sixty-two thousand five hundred (562,500) Magic Points, which corresponds to one thousand eight hundred (1,800) Piggy’s Money.
Cost Deduction: The Piggy’s Money accumulated during this phase shall not be deducted from the user’s virtual piggy bank. These units may be retained and utilized in Step 2 to obtain additional Standard Keys.

Step 2: Accessing the Prize Cave – “The Inca Adventure”
Description: This step pertains to gaining entry into the Prize Cave, referenced in-game as “The Inca Adventure.”
Exchange Reference Units: Standard Keys, which may be exchanged for higher-tier Keys pursuant to the conversion structure set forth below.
Fixed Exchange Rates: One (1) Standard Key shall be issued for every two thousand one hundred eighty-seven and fifty hundredths (2,187.50) Magic Points accumulated.
Ten (10) Standard Keys may be exchanged for one (1) Rare Key. Ten (10) Rare Keys may be exchanged for one (1) Mystical Key. Ten (10) Mystical Keys may be exchanged for one (1) Golden Key. Only complete sets of ten (10) Keys of the same type category are eligible for such conversions.
Cost of Access: To access the Prize Cave, the user must possess the equivalent of: Ten (10) Standard Keys, Three (3) Rare Keys, One (1) Mystical Key, One (1) Golden Key.

Step 3: Claiming a Tangible Reward
Description: This step involves the redemption of a physical, tangible reward.
Exchange Reference Units: Piggy’s Money units and Standard Keys, which may be exchanged for higher-tier Keys pursuant to the conversion structure set forth above.
Fixed Exchange Rates: Identical to those set forth in Step 1 and 2 above. Cost and Conditions: The detailed cost structure and conditions applicable to each tangible reward are set forth in Section 5.4.6.2, Paragraph 3, below.

5.4.6.2 STEP-BY-STEP TANGIBLE REWARD REDEMPTION PROCESS

The process for redeeming tangible rewards is governed by a sequential three-phase structure, implemented to ensure fairness and transparency:

Step 1: Unlocking Game Tracks: Users accumulate one thousand eight hundred (1,800) Piggy’s Money units, equivalent to five hundred sixty-two thousand five hundred (562,500) Magic Points, to unlock the nine (9) tracks.

Step 2: The Inca Adventure: During this phase, the user’s in-game avatar (“Piggy”) passes through eight (8) successive gates, each opened with the required Keys, to reach the Prize Cave.
Mechanics and Key Requirements: To initiate this phase, users enter the Forge, where Piggy’s Money is converted into Standard Keys at the fixed rate of seven (7) Piggy’s Money per Standard Key, whatever the grids and plaques. Plaques and grids display this conversion: the material or type of a plaque never changes the number of Keys. No exchange of plaques changes a player’s Magic Points or the number of Keys to which they are entitled. Magic Points, Keys and Piggy’s Money can never be transferred, sold or gifted. Plaques can never be transferred or sold; a plaque can only be exchanged, through the features provided in the game, for another plaque of the same value in the same collection. To progress through the eight (8) gates and thereby reach the Prize Cave, users must insert the requisite number and type of Keys in strict sequential order. The first gate requires one (1) Standard Key; the second gate requires two (2) Standard Keys; the third gate requires three (3) Standard Keys; and the fourth gate requires four (4) Standard Keys. The fifth gate requires one (1) Rare Key; the sixth gate requires two (2) Rare Keys; the seventh gate requires one (1) Mystical Key; and the eighth and final gate requires one (1) Golden Key. Each gate opens as soon as the required Keys are inserted, in the order set out above.

Step 3: Claiming a Tangible Reward from the Prize Cave: Upon gaining entry to the Prize Cave, the user may redeem a tangible reward of their choosing. Redemption of such a reward requires the expenditure of Piggy’s Money units held in the user’s virtual Piggy Bank, in addition to the Keys. This Piggy's Money is taken from the same Magic Points: the total prices below include it. The game is programmed to ensure that, once a user accumulates the requisite number of Magic Points to qualify for a given reward, they will concurrently possess a sufficient quantity of Piggy’s Money units to unlock said reward. When prompted, the user must insert the appropriate Keys to initiate the delivery sequence associated with the selected reward. These Keys shall be obtained in the manner previously outlined in the Inca Adventure phase. Once the reward has progressed to the delivery truck within the game interface, the final phase of fulfillment shall be triggered, thereby initiating the physical shipment of the prize in accordance with the procedures detailed in Section 5.5 of these Terms and Conditions.

THE PLAQUES ISSUED TO A USER ARE DERIVED FROM THE TOTAL NUMBER OF MAGIC POINTS ACCRUED BY THAT USER, AT THE FIXED RATIOS SET OUT IN THIS SECTION. THIS STRUCTURE IS DETERMINISTIC AND INVOLVES NO CHANCE.

The number and type of Keys required to claim each tangible reward are determined as follows:

5.5 Tangible rewards delivery

5.5.1 Delivery validation

An “Authorized Reward Recipient” is defined as:
1. The natural person who registered the account for the Participating Game in which the reward is being claimed;
2. A participant who has met the eligibility requirements outlined in Section 5 and all related provisions, including participation in the Programs to accumulate Magic Points (e.g., Apple Contests and Loyalty Programs on other platforms);
3. A participant who has redeemed their Magic Points for a tangible reward and triggered the delivery procedure in accordance with the corresponding procedures of the Participating Game;
4. The individual responsible for the email address associated with the account; and
5. A participant who has provided all Verification Documents including “Supporting Documents”, “Identification Documents”, and, where applicable, the completed IRS Form W-9 as outlined below.

Verification Requirements for Claiming Tangible Rewards
To claim a tangible reward within our game Apps, participants must submit specific documents as part of the verification process. These requirements include a completed and electronically signed Affidavit of Eligibility/Compliance and a Liability Release (collectively referred to as the “Supporting Documents”). The Supporting Documents are mandatory for all claims of tangible rewards, irrespective of the Approximate Retail Value (ARV) of the reward, to confirm the participant’s eligibility and compliance with these Rules. Participants must also provide proof of identity and current address, collectively referred to as the “Identification Documents.” Acceptable Identification Documents include:
1.A government-issued photo identification; and
2.A proof of current address, such as a scanned or photographed utility bill.

Tax and Documentation Requirements
Rewards redeemed through Magic Points may have tax implications depending on the method through which the Magic Points were earned and the participant’s jurisdiction. It is the sole responsibility of participants to verify the applicable tax laws in their country and ensure compliance with any reporting or tax obligations.
1. Rewards Redeemed via Magic Points Earned Through the Loyalty Program: As tax laws vary by jurisdiction, participants are responsible for determining whether any reporting or tax obligations apply to such rewards in their country.
2. Rewards Redeemed via Magic Points Earned Through Contests: Rewards redeemed using Magic Points earned through participation in Contests may be subject to tax reporting and obligations in certain jurisdictions. Participants must comply with the provisions outlined in Article 6 of the Contest Rules, which governs the reporting of contest prizes and any associated tax obligations.
3. Special Requirements for U.S. Participants Claiming Tangible Rewards: For participants in the United States, tangible rewards with an Approximate Retail Value (ARV) reaching, in total, US$2,000 or more in a calendar year (the reporting threshold of U.S. tax law from 2026, which may be adjusted for inflation from 2027)—redeemed through the conversion of Magic Points into “Exchange Reference Units” within a Participating Game App—require the recipient to provide a completed IRS Form W-9 prior to the delivery of the reward, so that FGA can issue the IRS Form 1099 required by U.S. tax law. The Sponsor reserves the right to withhold delivery of any tangible reward until the participant has submitted a completed IRS Form W-9, along with any other documentation reasonably required to ensure compliance with U.S. federal tax reporting obligations. The submission of IRS Form W-9 is necessary to meet federal tax reporting requirements and to finalize the reward delivery process. Participants acknowledge that it is their responsibility to verify the applicable tax regulations in their jurisdiction and to comply with all relevant tax laws. For assistance, participants are advised to consult a tax professional or the appropriate tax authority.

Failure to Comply
Failure to submit any of the required Supporting Documents, Identification Documents, or, where applicable, the completed IRS Form W-9 within sixty (60) days of FGA's request will result in the forfeiture of the tangible reward; the Magic Points spent on it are returned to the player. FGA sends a reminder before the end of this period.

Responsibility of Participants
FGA is not responsible when a participant cannot use, accumulate or exchange Magic Points, Exchange Reference Units or tangible rewards because the participant has not met the conditions of these Rules, for example by not providing the required documents.

Eligibility Limitation
Tangible rewards will only be sent to an “Authorized Reward Recipient” as defined above. In the event of clearly identified fraud, FGA reserves the right to cancel any reward obtained in the game.

Notification
Upon authorization as an Authorized Reward Recipient, the participant will receive an email notification confirming the shipment of their tangible reward. This notification serves as confirmation that the reward is being processed and dispatched in accordance with the delivery procedures outlined in these Rules.

5.5.2 Delivery process, costs, and minimum delivery time commitment

ALL DELIVERY COSTS FOR THE REWARDS ARE FULLY COVERED BY THE PROGRAM, with no additional fees charged for shipping. However, in certain jurisdictions, local customs authorities may require recipients to pay applicable duties or taxes upon delivery of the shipped products. For rewards valued at over one hundred US dollars (100 USD), sourcing is carried out through established and reputable e-commerce platforms selected based on the recipient’s location. These platforms include, but are not limited to: Amazon, Walmart, eBay, Alibaba, Best Buy, Target, Fnac, Cdiscount, Veepee, Argos, John Lewis, Catch, Kogan, and Takealot. Products valued at one hundred US dollars (100 USD) or less are generally shipped using standard postal services. Recipients are solely responsible for the payment of any customs duties or taxes imposed by their local customs authorities at the time of delivery of their tangible reward. Personal information, including the address and phone number provided via the Real-Life Prizes Registration Form, is shared exclusively with the selected shipping platform and courier service for delivery purposes. The processing of this personal data is governed by the Privacy Policy, available at: https://rules.universal-game-connect.com/v2/PrivacyPolicy/?lang=en. In the event that a reward cannot be delivered due to the recipient’s unavailability or failure to collect the reward, and provided the initial shipment was correctly processed according to the details provided in the Real-Life Prizes Registration Form, the recipients will be responsible for the costs of reshipping. Recipients will have a period of thirty (30) days to settle these reshipping fees. Failure to do so within this period will result in the reward being considered abandoned and forfeited; the Magic Points spent on it are returned to the player. These provisions specifically apply in cases where recipients fail to properly receive or collect their rewards, despite the Sponsor having adhered to the delivery details provided. These terms and conditions are designed to comply with the laws and regulations applicable in the jurisdictions where the rewards are offered.

Rewards are generally shipped within six (6) to sixty (60) days; the delivery date must not exceed three months from the date of authorization as an Authorized Reward Recipient for a Reward, in accordance with the timelines established in these Rules.

5.5.3 Product Unavailability

In the event that a product is unavailable from the supplier, the Sponsor will replace the item with a product of comparable or superior quality and of equal or greater value than the originally designated item. FGA customer service team is committed to ensuring fairness and participant satisfaction and will make every reasonable effort to consult with the recipient regarding the replacement product to address their preferences and ensure their contentment with the substitution.

5.5.4 Gift vouchers (monetary equivalent)

The Promotional Programs also provide the option to deliver tangible rewards as monetary equivalents. Depending on the recipient’s preferences and eligibility, these gift vouchers may be issued as Amazon gift cards sent electronically to the email address associated with the participant's account. Gift vouchers can only be used to buy goods or services from the retailer that issues them; they cannot be exchanged for cash, except where the law requires it. The format of the gift voucher will be determined based on the availability of the specified method in the participant's jurisdiction. All gift vouchers are subject to the same verification process as other tangible rewards, including the submission of Supporting Documents, Identification Documents, and, where applicable, IRS Form W-9 for U.S. participants whose rewards reach that threshold (Section 5.5.1). By selecting a gift voucher, participants acknowledge and agree to comply with all tax reporting obligations associated with receiving gift vouchers, as outlined in these Rules and applicable laws in their jurisdiction.

6. PRIVACY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FGA, THEIR LICENSORS OR SUPPLIERS AND ANY OF THEIR EMPLOYEES, CONTRACTORS, OFFICERS, DIRECTORS OR SHAREHOLDERS SHALL NOT BE LIABLE FOR ANY COMPENSATORY, DIRECT, CONSEQUENTIAL, INCIDENTAL, INDIRECT, SPECIAL, PUNITIVE, OR OTHER DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OTHER PECUNIARY LOSS OR DAMAGE TO YOUR COMPUTER HARDWARE OR SOFTWARE) ARISING OUT OF THESE TERMS OR THE USE OF OR INABILITY TO USE THE SERVICES, EVEN IF FGA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOU ACKNOWLEDGE AND AGREE THAT FGA IS NOT LIABLE FOR ANY ACT OR FAILURE TO ACT ON THEIR OWN PART, OR FOR ANY CONDUCT OF, OR COMMUNICATION OR CONTENT POSTED WITHIN THE SERVICES. IN NO EVENT SHALL FGA OR THEIR EMPLOYEES’, CONTRACTORS’, OFFICERS’, DIRECTORS’ OR SHAREHOLDERS’ LIABILITY TO YOU EXCEED THE AMOUNT THAT YOU PAID TO FGA FOR THE SERVICES. IN THE EVENT A STATE OR JURISDICTION DOES NOT ALLOW THE EXCLUSION OR THE LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, IN SUCH STATES OR JURISDICTIONS, FGA LIABILITY SHALL BE LIMITED TO THE FULL EXTENT PERMITTED BY LAW. YOU FURTHER ACKNOWLEDGE THAT FGA IS NOT LIABLE, AND YOU AGREE NOT TO SEEK TO HOLD FGA LIABLE, FOR THE CONDUCT OF THIRD PARTIES, INCLUDING OTHER USERS OF THE SERVICES AND OTHER EXTERNAL SITES, AND THAT THE RISK OF USING OR ACCESSING EXTERNAL SITES RESTS ENTIRELY WITH YOU. Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud or wilful misconduct, or any liability that cannot be limited or excluded under the law applicable to you; for consumers residing in the European Union, the European Economic Area, the United Kingdom or Switzerland, the limitation to the amount paid does not apply.

9. TERMINATION

You may terminate your Account at any time, as provided in Section 2.3. FGA may terminate your Account for a material breach of these Terms after notice, or suspend it immediately in case of fraud, cheating or a risk to other users. Virtual Items, Magic Points and reward progress are forfeited only in the cases set out in Section 3.3.

10. NO ASSIGNMENT

These Terms and the licenses granted to you herein are personal to you, and may not be assigned without FGA's express written consent.

11. COPYRIGHT INFRINGEMENT NOTIFICATION PROCEDURE

12. MISCELLANEOUS

a. Arbitration & Jurisdiction. You and FGA agree that the exclusive remedy for all disputes and claims relating in any way to, or arising out of, these Terms, the Services, or your use of the Services shall be final and binding arbitration. The arbitration shall be conducted by a single arbitrator under the Commercial Arbitration Rules of the American Arbitration Association ("AAA") and AAA’s Supplementary Procedures for Consumer Related Disputes ("AAA Consumer Rules"). To the fullest extent permitted by law: no arbitration under these Terms shall be joined to any other arbitration, including any arbitration involving any other current or former user of the Services; no class arbitration proceedings shall be permitted; no finding or stipulation of fact in any other arbitration, judicial or similar proceeding may be given preclusive or collateral estoppel effect in any arbitration hereunder (unless determined in another proceeding between you and FGA); and no conclusion of law in any other arbitration may be given any weight in any arbitration hereunder. You and FGA must commence an arbitration by filing a demand for arbitration with the AAA within ONE (1) YEAR after the date the party asserting the claim first knows or reasonably should know of the act, omission or default giving rise to the claim; and there shall be no right to any remedy for any claim not asserted within that time period. If applicable law prohibits a one-year limitation period for asserting claims, the claim must be asserted within the shortest time period in excess of one year that is permitted by applicable law. You and FGA may litigate in court only to compel arbitration under these Terms, stay proceedings pending arbitration, or to confirm, modify, vacate or enter judgment on the award rendered by the arbitrator(s). You and FGA hereby consent to the exclusive jurisdiction of and venue in the United States District Court for the Eastern District of Pennsylvania or, if that court shall lack jurisdiction, to the Court of Common Pleas situated in the Philadelphia County, Pennsylvania to enforce the provisions of this Section and to resolve any disputes and claims cognizable in court relating in any way, or arising out of, these Terms, the Services or your use of the Services. The court, not the arbitrator, shall determine arbitrability and enforce the arbitration agreements contained herein, including the prohibition on consolidated arbitrations and class arbitration. These Terms, the rules of each Promotional Program and all disputes and claims relating in any way to, or arising out of, them, the Services or your use of the Services shall be governed by the laws of the Commonwealth of Pennsylvania and the Federal Arbitration Act, without reference to choice of law principles. If you are a consumer, you also keep the protection of the mandatory rules of the country where you reside.
Consumers residing outside the United States. If you are a consumer residing in the European Union, the European Economic Area, the United Kingdom or Switzerland, or in any other country whose law does not allow it, the arbitration agreement, the waiver of class proceedings, the one-year time limit and the choice of Pennsylvania courts in this Section do not apply to you: you may bring any claim before the courts of your place of residence, within the time limits set by your law.

b. Complete Agreement. These Terms shall constitute the complete and exclusive agreement between you and us. The Terms may not be modified by you except in a writing duly signed by you and an authorized representative of FGA. If any provision herein is held to be unenforceable for any reason, such provision shall be reformed only to the extent necessary to make it enforceable, and such decision shall not affect the enforceability of such provision under other circumstances, or of the remaining provisions hereof under all circumstances.
